1. Alle varer sælges som beset uden nogen form for garanti og reklamationsret. Reklamationer tages ikke til følge. Der kan ikke gøres ansvar af nogen art gældende over for hverken auktionsleder, auktionsholder, rekvirent eller skifteret. Dette omfatter ansvar for funktionsduelighed, stand, lovlighed, angivelser af mål, vægt, dimensioner, alder og beskrivelse.

2. Ved forhåndsbud på nettet gør vi opmærksom på at der afgives forhåndsbud/maxbud op til dagen til den fysiske auktion på stedet,og bud fra nettet medtages på dagen, bliver der budt det samme eller over i salen på selve auktionsdagen har man tabt budet,dvs. du kan godt stå som du har højeste bud på nettet og så ikke vinde budet, "Mine Bud" bliver ikke opdateret efter selve auktionen. Vi kontakter kun vindende bydere, har du ikke fået besked dagen efter auktionen, har du ikke vundet noget. Eller har du budt DIT MAX BUD eks. (på en auktion var der et forhåndsbud på 40.000 kr på net og det højeste bud på dagen var 33.000 i salen,så vandt forhåndsbyder varen til 34.000 kr. SÅ BYD DET DU MAX VIL GIVE. 

3. Dette er ikke en netauktion og alle bud er bindene, Kun vindene bydere modtager besked på mail eller tlf. efter auktionen (dog senest første hverdag efter auktionen) og skal straks betale/overføre beløbet til vor Konto nr. 9873 0002439611.eller betale ved afhentning, og selv afhente varen eller sørge for afhentning senest 2 hverdage efter auktionen. HMA står ikke for bestilling af evt.fragtmand. HAR KØBER IKKE BETALT / HENVENDT SIG. SENEST 3 HVERDAG EFTER AUKTIONEN SPÆRRES BRUGEREN PÅ VORES SYSTEM OG VAREN BLIVER SOLGT TIL ANDEN SIDE. OG ALLE UDGIFTER I FORBINDELSE MED DETTE + SALÆR AF DET KØBTE, SKAL BETALES AF KØBEREN.+ Gebyr for genåbning af bruger konto kr. 1000 + moms.

4. Til budsum lægges auktionssalær: 15 % af budsum (dog min. 100,- kr. pr. enhed) + 25 % moms ved salg til kunder, som bor i Danmark. Eksempel: ved bud på 1000 kr. + 15% salær = 1150 kr. +  25% moms = 1437,50 kr. Visse køretøjer er undtaget for moms på budsum, men der skal betales moms af salær. Der er på faste auktioner i Ikast på Personbiler og Varevogne u.3500 kg 15% Salær og Makssalær på kr. 4200.- eks.moms. Udover vores alm. auktionssalær og moms betales ikke andre gebyrer o.lign.

5. Der opkræves ikke moms af købere bosiddende i EU uden for Danmark, hvis køber oplyser gyldigt momsnummer og underskriver erklæring på at de købte varer udføres af danmark. Er køber bosiddende uden for EU opkræves der ikke moms, men varen udleveres ikke før Hma har modtaget udførselserklæring fra speditør. Enkelte effekter kan være momsfrie dette vil stå ud for hver eller blive oplyst i auktionsvognen.

6. Varerne betales i kontanter, check eller dankort på auktionsdagen. Husk Billedelegitimation. Eurocard og Mastercard modtages ikke. VED BETALING VED FORHÅNDSBUD/AFHENTNING efter auktionsdagen kan der betales med dankort. Varerne (ejendomsretten) overgår først til køber, når check/dankort bliver indløst med kontanter. Overførsel kan ske til vor Konto nr. 9873 0002439611. Udenlandske købere kan benytte bankoverførsel via IBAN umiddelbart efter auktionen.

7. Varerne skal afhentes senest xxx (se auktionskataloget) kl. 16.00. For varer, der står derudover  laves særaftale med arrangørerne ved auktionen. FOR VARER DER STÅR DERUD OVER BETALES PLADSLEJE KR. 100.- PR. KATALOG NR. PR.DAG

8. Sælger (kurator) garanterer varerne frie og ubehæftede for pant og restgæld af enhver art.

9. Opstår der under auktionen tvivl om, hvem der er højstbydende, afgør auktionslederen, om der evt. skal finde nyt opråb sted.

10. Køber har det fulde ansvar for, at det købte opfylder alle lovmæssige krav, godkendelser og må ikke anvende varen før disse er opfyldt, udover til ophug.

11. Efter hammerslag står varen for køberens egen regning og risiko i enhver henseende. Strømførende effekter må kun afmonteres af aut. elektriker.

12. For evt. skader på bygninger og maskiner,biler ved læsning af auktionsvarerne er HMA ikke erstatningspligtig. Der tages forbehold for evt. trykfejl.

13. Salget sker uden ansvar for auktionsleder og auktionsholder. Al færdsel på  auktionsområdet sker på eget ansvar.

14. De købte effekter må ikke medtages fra auktionen inden betaling af disse på auktionskontoret, Alt tyveri eller forsøg på tyveri bliver anmeldt til politiet

15. Enhver handel på auktionsområdet skal registreres på HMA´s formularer, og i øvrigt følge auktionsbetingelserne. 

16. Såfremt man ikke kan være til stede på auktionsdagen, kan man afgive forhåndsbud efter log ind her på vores hj.side,  (eller send en på fax 97 153141. Eller e-mail post@hma-maskinauktion.dk med angivelse af katalog nr. navn adr. tlf.) Alle bud er bindene. Der er forud for alle auktioner mulighed for at gennemgå effekterne ved et eftersyn.

17. Hma forbeholder sig ret til at kontrolere brugere ved log ind,  (tlf nr, adresse, cvr.nr mv.) Samt at udelukke useriøse brugere fra systemet.

Personnel will be on hand sale day to assist in organizing transfer of funds. Some equipment may require modifications to

meet foreign import and safety regulations. To avoid potential problems, please contact your customs broker or authorities.

Notice to All Buyers:

Some of the equipment may be free of duty for use within the European Economic Community and will be identified in the

sale day catalogue. Duty and documentation required for importation of equipment into any country, if applicable, is the

purchaser’s responsibility and such duty and documentation will be processed through the purchaser’s broker directly. Value

Added Tax (VAT) will not apply to properly exported goods provided HMA has your valid VAT registration number, but will apply to items destined for Denmark.

Auction conditions Remember picture ID at registration and payment

1. All products sold as is without any guarantee and warranty. Complaints are dismissed. There can be no liability of any kind against either the auction manager, auctioneer, requisitioner or probate. This includes responsibility for the functioning, capable, legality, indications of target weight, size, age and description.

2. 4. Proposed price to be auctionfee: 15% of the tender (but min. 100, - kr. Unit) + 25% VAT on sales to customers who live in Denmark. Example: the bid for 1000 kr + 15% commission = kr 1150 + 25% VAT =  1437.50 Certain vehicles are exempt from VAT on the proposed price, but VAT to be paid by fees.

5. There are not charged VAT on the buyers living in the EU outside Denmark, where the buyer informs valid VAT number and sign the declaration on the goods purchased out of Denmark. Is the buyer resides outside the EU VAT is not levied, but goods not delivered before the HMA has received export declaration by shippers. Some effects may be tax free this will stand next to each or be given in the auction cart.

6. Goods are paid in cash, check or cash in on auction day. Remember picture Credentials. Eurocard and Mastercard are not arriving. FOR PAYMENT BY FORHÅNDSBUD / pickup after auction day may be paid with credit card. Goods (property) is transferred first to the buyer when the check / debit card will be redeemed in cash. The transfer can happen to our Item No. 9873 0002439611. Foreign buyers can use bank transfer via IBAN immediately after the auction.

7. The goods must be claimed no later than xxx (see auction catalog) pm. 16.00. For products which are additionally made special arrangement with the organizers of the auction. OF GOODS STANDS ALSO PAID SPACE RENTAL KR. 100th - PR. CATALOG NO. Per day

8. Selling (curator) warrants the goods free and ubehæftede the mortgage and outstanding debt of any kind.
